Why does a three-family Park Slope house lose this argument before it starts?
Because nobody in it is clearly in charge of the two things that decide the outcome.
Roughly 35.2 per cent of Park Slope’s housing units sit in buildings holding two, three or four units. That figure looks like a statistic and behaves like a governance structure. It describes a band of building that is neither of the two types the pest trade is organized around. It is not a single-family house, where one household owns the roof, the cellar, the bins and the decision. It is not an apartment building either, where a managing agent holds a contract, a superintendent takes the trash out at a fixed hour, and a porter notices a hole in a wall because noticing is part of the job.
It is a brownstone where the owner lives on the parlour and upper floors, one household rents the garden apartment, another rents the top, and there is no staff at all. There is no super. There is no agent. There is no maintenance schedule. There is frequently no written agreement about who takes the bins to the curb, who brings them back in, who owns the space they live in between collections, and who is supposed to notice when a lid stops closing.
That is the whole problem, and it is worth being blunt about it, because the biology in this neighborhood is ordinary. Norway rats and house mice behave here exactly as they behave anywhere else in the city. What is unusual about this band of housing is administrative. Rodent outcomes are decided by refuse discipline and by physical sealing, both of which require somebody to own the task, hold the budget, and keep doing it after the crisis passes. In a house with a super, that person exists. In an owner-occupied three-family, they exist only if the owner decides to be them.
Three consequences follow that we would rather set out at the start than discover halfway through a job.
The owner is a landlord whether or not they think of themselves as one. A great many people who bought a house in this neighborhood and let two units to help carry it do not conceive of themselves as operating rental property. The Housing Maintenance Code does not share that view, and neither does anything else that governs multiple dwellings.
The response is reactive by construction. Buildings with staff find problems early because somebody is in the cellar weekly. Buildings without staff find problems when a resident is frightened enough to say something, which is typically months later and several floors from the source.
Money is a live conversation, not a line item. In a managed building the reserve absorbs a rodent program. Here it comes out of a household’s own account, and the temptation to buy the cheapest version of the work is real and understandable.
What does the slope do to where the animals are?
It sorts them, and it puts a genuinely different problem at each end of the neighborhood.
Park Slope is the western flank of the Harbor Hill Moraine, the terminal moraine of the last glaciation. The ground falls continuously westward from Prospect Park West across the avenues to Fourth Avenue, and beyond it to the Gowanus lowland at sea level. That is a real gradient inside one neighborhood, and it moves two things: water, and everything that follows water.
On the upper slope, near the park frontage and the Grand Army Plaza end, water leaves the ground quickly. Cellars there are typically drier, drainage runs downhill with a will, and the rodent picture is dominated by what is above ground: the block interior, the tree pits, the refuse on the avenue corridors, and the ordinary business of animals crossing between gardens. The route into a building is usually something you can see if you look — a gap at an areaway, a failed cellar window, a service penetration behind planting.
On the lower slope and down toward the flat land at the bottom, the picture inverts. That ground is where the water from everything above it ends up. The Gowanus Canal has fourteen combined sewer overflow points, was designated a Superfund site in 2009, and heavy rain there floods streets and causes sewage lines to overflow. Much of that low ground sits in a Zone A flood risk area. What that means for a building is a stressed drainage network at its low point, and a stressed drainage network surcharges backwards.
The practical translation is this. On the lower blocks, and on any block where the drainage connection has been quietly failing for decades, rats commonly arrive from below rather than from outside. A deteriorated house trap, a cracked line under a cellar slab, a floor drain that has been dry for a season — each of those makes the inside of the building continuous with the sewer under the street. A building experiencing that reports rats indoors with no burrows in the yard, activity that carries on regardless of anything done outside, and a pattern that gets worse after storms because the system beneath is being flushed. If that description fits, the next call is a plumber with a camera, not a pest contractor with a bait station, and we would rather say so early than sell an indefinite service schedule against a plumbing defect.
Between the two extremes, most of the neighborhood has some of both. What the slope reliably tells you is which to look at first.
Who actually owns the refuse problem here?
The owner does, and in this housing band the owner is usually also a resident, which changes the psychology of the conversation more than people expect.
The Health Department’s guidance on what sustains a rat population is short and correct: rats need food, water, shelter and safe routes, and exposed garbage attracts them. Keeping them out of a building is a legal duty placed on whoever owns it. That is the whole doctrine, and none of it is technical.
What makes it hard in a two-to-four-unit house is that the food supply is generated by households the owner does not control and cannot supervise. A tenant who bags trash loosely, leaves it on the areaway steps overnight, or misses a collection day is not doing anything unusual — they are doing what people do when nobody has explained why it matters on this particular block. There is no porter to correct it silently at six in the morning.
So the fix is procedural rather than chemical, and it is worth spelling out because it is the highest-return item on the whole page.
Containment before timing. Rigid, hard-sided containers with lids that actually close, sized for what the building generates, stored somewhere an animal cannot work at them uninterrupted overnight. Bags on a step are a feeding station whatever hour they went out.
A named person per task. Who brings the containers out. Who brings them back in. Who washes them when something splits. Who checks the lids still seat. In a house with three households, an unassigned task is an unperformed task.
A conversation with the tenants that is about the building rather than about blame. Most people cooperate immediately once they understand that the loose bag on the steps is what is producing the animal they saw on the stairs. Very few cooperate with a notice taped to a door.
The areaway. The front areaway of a Park Slope house is a sheltered, low, partly enclosed space with a drain in it, and it is where bins usually live. It is also directly against the cellar wall and its openings. Refuse stored badly in an areaway is refuse stored against the single most important surface on the building.
None of this reduces the block’s rat population by itself. What it does is remove your building from the list of properties supporting it, which is the only part of the block you actually control.
What does the rear yard look like from a rat’s point of view?
Like one long terraced habitat that steps downhill and has no owner.
The rear yards on a Park Slope block back onto one another and form a continuous interior. That much is true of attached housing anywhere. What is specific here is that the block interior is on a hillside, so the yards step down across the block in a series of levels, and the levels are held by retaining walls.
Retaining walls are the detail worth understanding. A wall holding back three feet of soil is, from below, a vertical face with a drainage problem behind it, and from above, a raised bed with a soft edge. Where it is dry-laid stone or old brick, it contains voids by construction. Where it is poured concrete, it has a drainage layer behind it and usually weep holes through it. Either way it is protected, well-drained ground with cover on top, which is close to an ideal burrow site, and there is one on nearly every property line on the slope.
Add the rest of the inventory. Raised beds built for planting. Decking laid over sleepers with a void beneath. Sheds and bike stores on paved pads. Composting, which is a genuine attractant unless it is in a rodent-resistant enclosure. Mature planting for cover. Paving slabs laid on sand, which settle and leave a gap at the edge. And, on the older houses, a rear extension whose foundation meets a yard that has been re-landscaped repeatedly since it was built.
An active burrow reads the same here as anywhere: an opening a few inches across at the base of a wall or under a structure, with a fan of loose soil outside and a beaten run leading away from it, edges clean and no cobwebs across the mouth. What is different is that on a terraced block the runs are frequently vertical as well as horizontal, following the retaining walls between levels.
Two operational points follow. The first is that filling burrows without addressing the food supply relocates them by a few feet and achieves nothing else. The second is that disturbance moves animals suddenly and predictably: a yard cleared, a deck lifted, a shed taken out, an extension started or a utility trench opened in the street evicts an established system, and the evicted animals go to the nearest shelter, which is somebody’s cellar. If work has started on your block, that is the week to look at your own penetrations, not the week after the sightings begin.
How does a mouse get from the garden apartment to the top floor?
Through the plumbing that was cut in when the house was converted, and through the framing it was cut through.
This is the part that surprises owners most, because the top-floor tenant’s report and the cellar’s condition seem unrelated. They are not. A subdivided rowhouse has a kitchen and a bathroom on every floor, and in almost every case they are stacked so they can share a waste stack and supply risers. That vertical run passes through every floor structure in the building.
It was made by somebody working in an occupied nineteenth-century house, cutting through original joists and plates to get a pipe from the cellar to the roof, at a time when nothing required the penetrations to be closed and no material was to hand for closing them properly. So each floor now has an opening around the stack, usually concealed inside a boxed chase, a cabinet base, or the void behind a bath panel. Stacked one above another, those openings are a continuous shaft from the cellar to the roof with a door on every level.
A mouse is at home in it. The shaft is warm, it is dark, it is never disturbed, it runs past the back of a kitchen unit on each floor, and it is entirely invisible from any room in the house.
The second route is lateral. The party walls of an attached house receive the floor joists of both buildings, and the recesses that take those joist ends were not closed when the houses were built. That gives a row of small horizontal voids in the shared masonry at each floor level. It is why work confined to your own front and rear walls covers half of the actual boundary of your building, and why a neighbor’s problem becomes yours without either of you doing anything.
The third route is the one people expect: the cellar and areaway line at ground level, service entries and their abandoned predecessors, cellar windows, the door threshold, and the gap where a redundant oil fill or an old lead water service was cut off and left.
The order in which these matter is not the order in which they get inspected. Most homeowners look at the front door and the windows. The productive work is in the cellar, in the chase, and inside the party wall.
How do you tell which flat the problem is in?
By reading the building rather than the complaints, because in this housing band the apartment that reports and the apartment with the population are frequently not the same flat.
Tolerance varies enormously between households. One resident reports a single sighting the day it happens; another lives with steady low-grade activity for a year and mentions it when the lease is up. Complaint order therefore tells you about people. It does not tell you about distribution.
What tells you about distribution is monitoring, run across the whole building at once. Devices in each flat, in the cellar, at the base of the stack and along the party walls, left long enough to accumulate a meaningful record, and read as a pattern rather than as individual results. Recording where something was found, not merely that it was found, is what converts a set of anecdotes into a map.
Three patterns come up repeatedly.
A gradient toward one kitchen or one bathroom wall means a source in that flat, usually at the stack, with the apartments above and below carrying the overflow. Treating the overflow flats produces a few good weeks and then the same call again, which is exactly what residents describe when they say the last contractor’s work did not hold.
Even density on every floor at the same intensity usually means the population is not moving between flats at all. It is coming up the shaft from the cellar, and the answer is at the base of the riser or in the drainage below the slab.
Activity concentrated along one flank with nothing at the stack points sideways rather than vertically. The neighbor’s building is part of the problem, and the conversation that has to happen is the awkward one across the party wall.
Evidence in the cellar is read the same way it is read in any old masonry building — rub marks along fixed routes, droppings graded by age and freshness, gnawing that is pale when new and darkens over weeks — but the value of it here is that it is the only unpoliced source of information in the building. Nobody sweeps a cellar to make a point. Which is precisely why it should not be swept before a survey.
What does an owner-occupier have to do that they may not know about?
More than most of them realize, and the obligations arrive with the third unit rather than with any decision the owner made.
A building arranged for occupancy by three or more independent households is generally a multiple dwelling. Given that roughly a third of this neighborhood’s units sit in two-to-four-unit buildings, a very large number of Park Slope houses are at or just over that line, often without the owner having thought about it since the closing.
The Housing Maintenance Code places the duty to keep a dwelling free from rodents, insects and other pests on the owner, and requires extermination where infestation is present. The plain reading is set out at the NYC Housing Maintenance Code and pests. That duty does not distinguish between an institutional landlord and somebody who lives on the second floor.
Local Law 55 of 2018 adds a scheduled obligation on top of the general one. Owners of multiple dwellings must investigate units and common areas at least annually and whenever a complaint arises, then remediate using integrated pest management — physically removing nests and debris, sealing openings so gaps are no wider than a quarter inch, and eliminating water sources — and the law states plainly that applying a pesticide does not substitute for those steps. Read honestly, that quarter-inch sealing requirement describes exactly the penetrations around the stack and inside the party wall that carry the traffic in this building type. It is not an administrative burden bolted onto the work. It is the work.

We are not in a position to advise anyone on their legal position, and this page does not attempt to. What we can say is which physical work the standards are describing, and that in a subdivided rowhouse the compliant answer and the effective answer are the same answer.
In what order does this actually get done?
Reduce, correct, close, verify — and the order is not a preference.
Reduce first. Sealing a building that still holds an established interior population takes away the animals’ way out. In an attached masonry house that means they concentrate in wall voids and party-wall pockets, where anything that dies is behind plaster and brick, unreachable and impossible to ignore for several weeks. Reduction means devices placed on the evidence — following rub marks and droppings, not convenient corners — checked often, over a period, before anything is closed. Rodents grow accustomed to the furniture of their environment and will route around a device placed where they were not already traveling.
Correct the conditions the building is offering. Refuse containment. The areaway drain and its floor. Any drainage defect the survey pointed at, referred to a plumber. Water sources indoors, which in a converted house means slow supply leaks under three separate kitchen sinks that three separate households have each decided is not worth mentioning.
Close, comprehensively rather than conveniently. The cellar line and its service entries, the openings around the stack at every floor, the areaway, the rear elevation, the roof and bulkhead, and party-wall pockets wherever a ceiling or wall is genuinely open. Materials have to be things an animal cannot bite through: mesh, hardware cloth, sheet metal, mortar or hydraulic cement. Cured expanding foam fails twice — the animal chews through it, and it looks like completed work, so a live opening gets recorded as closed. Openings that cannot be reached are written up as inaccessible rather than left off the list. A perimeter that is ninety per cent closed is not ninety per cent effective.
Verify, after weather. The step everybody skips. A hundred-and-forty-year-old masonry building moves, and a winter of freeze-thaw opens joints that were sound in October.
The calendar is genuinely useful here. Late summer into autumn is the window that decides the year: cooling nights push animals toward buildings, and a cellar closed in September never takes on the winter population it would otherwise carry to spring. Autumn and winter storms are when the drainage tells the truth, because a blocked areaway drain or a failed house trap only announces itself under load. Spring is the masonry season, when freeze-thaw has left its record in open joints and spalled brownstone. Summer is for the yard: regrading, clearing, rebuilding waste storage, and dealing with the retaining walls while the ground is workable.
What does one house achieve, and what needs the block?
A house can decide whether it is infested. Only the block can decide how much pressure it is deciding against.
That distinction is worth holding onto, because it prevents both of the common errors. The first error is fatalism — assuming that because the block interior is shared, nothing done to your own building matters. It matters entirely: whether the animals in that shared habitat get inside your house is a property-level question answered at the cellar line, the areaway, the penetrations and the drain. The second error is the opposite, assuming that a well-sealed house will reduce the block’s population. It will not. It removes you from the problem without changing it.
Where several neighboring houses act together, the arithmetic changes. Containment agreed across a ring of properties lowers what the interior can support. Party-wall closure done from whichever side is open — usually during somebody’s renovation, which is the only time the access exists — is permanent, because it is a physical alteration rather than a residue. And neighbors knowing when reduction work is happening next door is worth more than any material, because it explains the fortnight of increased sightings they are about to experience and gives them the chance to have their own cellar looked at in the same window.
That is not a sentiment about community. It is the reason a block association can outperform a contract, and it is the one form of leverage available to a housing band with no staff.

We own a three-family house and live in it. Who is supposed to handle the bins?
Legally the owner, which is you, even though the trash is mostly your tenants'. That is the single most common gap in this housing band: an apartment building has a super who does it, a single-family house has one household who does it, and an owner-occupied three-family often has an informal arrangement nobody wrote down and nobody enforces.
Why do the houses at the bottom of the slope have a different problem?
Because the ground falls continuously from Prospect Park West toward Fourth Avenue and the Gowanus lowland, which sits at sea level. Water and the drainage that carries it arrive at the lower blocks, and the combined system there has fourteen overflow points on a waterway that floods streets in heavy rain. Below-grade routes matter more down there.
Can we just seal the cellar and be done with it?
Not in that order, and not on its own. Closing a building that still holds an active population shuts the animals in rather than out, and they end up in wall voids where nothing can reach them. Reduction runs first. Sealing also does nothing about the block interior, which is where the rats supporting the pressure actually live.
Our top-floor tenant hears scratching but the cellar looks clean. Is that possible?
It is the normal pattern in a subdivided rowhouse. The retrofitted plumbing that serves the upper apartments was cut through original framing decades after the house was built, and nobody sealed the penetrations. A mouse entering at cellar level can reach a top-floor ceiling without crossing a single room.
Does landmark designation stop us doing the work?
Almost none of the productive work is on the protected streetscape. The cellar line, the areaway floor and drain, the rear elevation and the roof carry the traffic, and none of those is the front of the house. Where a scope does touch the visible exterior, review changes the timetable rather than the answer.
How do we get into a tenant's apartment to place monitors?
With written notice and a reasonable arrangement, planned before the work is booked rather than on the morning. Access is the item most likely to derail a job in this housing band, because the owner controls the building but not the rooms, and a monitoring program that covers two flats out of three reads the building wrong.
Is the block association worth joining for this?
For rats, yes, more than any product. The rear yards on a Park Slope block form one continuous interior, and the population in it is set by the worst-managed property on the ring. Waste containment agreed across several houses changes the block's carrying capacity in a way that no single household can.
What should we not do before someone surveys the cellar?
Do not clean it. Droppings, rub marks and gnawing are the only record of where animals actually travel, and a swept floor has destroyed it. Pulling stored goods a foot away from the walls so the perimeter can be seen is genuinely useful. Scrubbing the morning of the visit is not.
